Supreme Court warns DMK Minister Senthil Balaji: Quit or lose bail

The Supreme Court told the leader of DMK on Wednesday, V senthil balaji, to make a decision “between the post and freedom”, since he warned him to cancel the bond if he did not resign as minister in Tamil Nadu.

A Bank of Judges Abhay S Oka and Augustine George Masih Tok exceptions to the fact that Balaji was reinstalled as a Tamil Nadu cabinet minister days after obtaining a bond in a case of money laundering related to the “cash for work” scam.

“There is a serious apprehension that it will interfere and influence the witnesses. You must choose between the position (minister) and the freedom. What choice do you want to do, it tells us,” he said.

The Superior Court referred to a previous sentence that registered that forced people to withdraw complaints against him. The concession of the bond did not mean power to influence the witnesses, he said.

“When it was a minister, the categorical findings have been registered against him in the way in which he caused the agreement and the procedures are annulled. The bail concession does not mean being able to influence the witnesses. In the past, witnesses have meant.”

The Superior Court, as a result, offered an option.

The Superior Court found a prime case facie against Balaji based on its past behavior which showed that “interfered and influenced” witnesses.

The lawyer Senior Mukul Rohatgi, who represents Balaji, said there was no direct finding against his client.

The main lawyer Kapil Sibal, on behalf of the government of Tamil Nadu, said that the trial could be transferred from the State if there was any possibility of influencing the witnesses.

The court does not agree, saying that no purpose would be delivered.

The solidor general, Tushar Mehta, who appeared for the Execution Directorate, referred to his affidavit claiming that Balaji influenced the witnesses.

“We will register it in the order in which we have made a mistake by ignoring the judgments against him, because the whole monkey prosecuted at the base that he is no longer a minister. We will accept our mistake,” Judge Oka shook.

When Sibal presented, there was no possibility that Balaji influences the witnesses, the Superior Court commented: “You (Balaji) are witnesses to come from coming.” The Apex court also expressed its apprehension for the surveillance of the Jastisrudce liberal bond developed by the court in cases of money laundering.

Balaji, 48, was sworn in as Minister by Tamil Governor Nadu Rn Ravi on September 29, last year and was assigned the same key portfolios, the development of unconventional energy, prohibition and consumption previously in the Stalin cabinet.

Balaji, which represents the Constitution of the Karur Assembly, was arrested on June 14, 2023 in the event that it was the Minister of Transportation during Aiadmk’s previous regime between 2011 and 2015.

On February 13, last year, the governor of TN accepted the resignation of Balaji of the Council of Ministers. The postponement of the Superior Court on September 26, 2024 ended the imprisonment of 471 days of Balaji.

The ED had presented a case of money laundering in July 2021 to investigate the accusations after the Tamil Nadu Police registered three FIR in 2018 and in the basic complaints of those injured in the scam with all the people.

His charges affirmed that the entire recruitment process in the State Department of Transportation of his mandate as a minister became a “corrupt cacio.”
